There's another class action lawsuit request connected to the Highway 25 toll bridge - this time over the recovery fees linked to unpaid tolls and delays in paying the toll bill.
"The question here is not negligence, it's about the legality of the fees imposed," said lawyer Cory Verbauwhede of the law firm Grenier Verbauwhede Avocats.
Verbauwhede said his client Ian Poitras was dinged $35 in recovery fees for every time he crossed the Highway 25 toll bridge since the automatic payment didn't go through for some reason - for a total bill of about $4000. The corporation overseeing the bridge kept sending notices to an old address listed in the Quebec Automobile Insurance Board registry.
Verbauwhede alleges the fees violate the Consumer Protection Act and are out of proportion since the toll is only arond $2.30 and the recovery fee for the Highway 30 toll bridge by comparison is only $6.
"The 35 dollars would represent something like 435% interest if you were to calculate it that way," said Verbauwhede in an interview with CJAD 800 News.
Verbauwhede also claims the bridge corporation did little to notify Poitras.
"We believe that there'll be tens of thousands of people affected by this. It happens quite a bit,"said Verbauwhede.
The corporation won't comment since it's now a legal matter.
Verbauwhede said it could be a year before they know the class action request is authorized or not. If it gets the green light, it could take another year to make it to the courts.
Two other class actions are under way targetting monthly fees and fees charged according to the time of day as well as the delays between the moment the motorist notices the fee and the time they notice their licence plate was photographed for billing.
