The government is still wrestling with the legality of photo radar in the wake of a court ruling last November that tickets issued by roadside cameras were considered hearsay and inadmissible evidence because a police officer did not physically witness the traffic violation.
The decision resulted in the entire system being shut down and photo radar tickets cancelled.
The Crown never appealed the verdict, but the government announced it would work to change the wording of the law.
Last summer, then Transport Minister Laurent Lessard announced the government had worked out the legalities and photo radar was back in business.
But that is apparently not accurate because only 552 photo radar tickets were issued province-wide in October, compared to an average of 3400 per month, when the tickets were still consider valid and legal.
The current Transport Minister André Fortin tells the Journal de Montreal that government lawyers are still working on the problem but the tickets that are being issued are being considered valid.
