A 59-year-old Sherbrooke man has been ordered to pay his neighbour $3,000 after he shot and killed her dog while it was in his backyard.
Last September, Serge Aubé was found guilty of killing Jessica Lambert's dog Kricji on the night of August 14, 2017.
That night while the dog was outside it managed to make its way into Aubé's backyard. He saw the dog from his window and noticed the animal was using his lawn as a bathroom. Aubé grabbed his rifle and shot the dog, hitting in the neck, killing it.
During the sentencing hearing on Tuesday, Judge Conrad Chapdelaine ordered Aubé to compensate Lambert for her loss and gave him a conditional discharge. To avoid a criminal record Aubé is not allowed to contact Lambert or own a firearm.
Chapdelaine said that Aubé's response to the dog doing its business in his yard was impulsive and out of frustration. The ruling noted that Aubé even tried to flee the scene but was stopped by neighbours.
The prosecution had asking for Aubé to be sentenced to six months community service, but the judge ruled that handing the man a criminal record could jeopardize his job.
