A house party in Montreal North may not have been the nightmare originally described.
Last March, four teens were accused of sexually assaulting a 13-year-old girl, filming the assault and posting it to social media. During the bail hearing for one of the accused a police officer described a night which saw the young girl pinned down by two boys while she was assaulted.
Now, that no longer appears to be the case.
In an email to Radio-Canada, Crown prosecutor Karine Destrempes said after reviewing all the evidence, supplemental investigations and speaking with witnesses, investigators concluded that no sexual assault occurred.
The newest version of events recently presented in youth court reveal on the night of the party the 13-year-old girl had sexual contact with a boy while another couple was in the same bedroom but in a different bed. It was during these moments that the encounter was captured on video with a cellphone and later posted to social media.
Two of the teens involved, a 14-year-old girl and 15-year-old boy, were in youth court two weeks ago where they pleaded guilty to a single child pornography charge. The sexual assault charge was dropped.
Both were sentenced to at 15 and 12 months' probation, community service and are forbidden to use the internet without supervision of a responsible adult aware of the conviction.
They are also ordered to complete a sex education program and not communicate with the victim.
Two other teens accused in the case will be in court later this summer.
